User Agreement for AdventureCinema.com

The following describes the terms on which AdventureCinema.com offers you access:

In this agreement, "we", "us" and "our" refers to Southwind Productions, its agents or assigns, owners,  joint ventures, suppliers, contractors and employees with regard to this website and related services (the "site"); "you" and "your" refers to the user, person or entity using this site; "merchant" refers to a seller whose products and/or services are as offered directly on this site, not through any link or listing referenced on this site. This agreement may be changed by us at any time without notice and is effective immediately upon posting. If you do not agree to be bound by this agreement, do not use this site or these services.

• Release. In the event that you have a dispute with one or more merchants, you release us from any and all claims, demands and damages (actual and consequential) of every kind and nature arising out of or in any way connected with such disputes.
• No Warranty. The site, products, services and information are provided "AS IS" and without warranty or condition, express or implied. To the extent allowed by law, we specifically disclaim any implied warranty, merchantability or fitness for a particular purpose or audience.
• Limitation of Liability. In no event shall you hold us liable for lost profits or any special, incidental or consequential damages arising out of or in connection with our site, our service, our information or this agreement, however arising (including negligence) to the extent allowed by law. Our liability to you or any third parties in any circumstance is limited to the actual amount of products or services purchased. Inclusion of any listing and/or link on this site is informational only and does not represent endorsement. We are not responsible for the content and/or operation of any linked site or listed reference.
• Indemnification. You agree to indemnify and hold us harmless from any claim or demand (including attorneys' fees) made or incurred by any third party due to or arising out of your breach of this agreement, or your violation of any law or the rights of a third party relating to your use of our site and/or services.

No material may be reprinted or redistributed without the express consent of the copyright or trademark owner(s).
• Replacement Policy. Unless otherwise specified, contact the individual merchant for information on how to place a claim for replacement in the event of a defect in manufacture. Unless otherwise specified, no refund can be given after the order has been shipped.
• Privacy Policy. Your privacy is important to us. We do not sell or rent your personal information to third parties for marketing purposes. Unless specified otherwise, the information you provide (through forms, buttons, shopping carts and other means) is only used by us for order processing, customer inquiry and communication with our merchants, contractors and payment providers if necessary to complete your transaction(s), shipment(s) and related payment(s). Unless otherwise specified, PayPal is the payment service provider for our site. Information you give to PayPal is protected by their privacy policy and subject to their user agreement (both are available at www.paypal.com). Credit card and bank account numbers are not transmitted to or stored on our site.
• General. We do not guarantee continuous, uninterrupted or secure access to our site. The operation and availability of our site is subject to factors outside of our control. If any provision of this Agreement is held to be invalid or unenforceable, all remaining provisions shall remain enforceable.
